Terms of Service

Welcome to Now (AUST) Pty Ltd (the “Company”). These terms of service (the “Terms”) govern your use of our consultancy services (the “Services”). By using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.

  1. Scope of Services

The Services provided by the Company consist of consulting and advisory services in the areas of business strategy, marketing, and operations. The specific scope of the Services will be determined through consultation with you and may include, but is not limited to, market research, competitive analysis, business planning, and implementation support.

  1. Fees and Payment

The fees for the Services will be agreed upon in advance and may be based on a fixed fee or an hourly rate. All fees are due and payable in full upon completion of the Services, unless otherwise agreed upon in writing. The Company reserves the right to terminate the Services if payment is not received in a timely manner.

  1. Confidentiality

The Company recognizes the sensitive nature of the information that may be shared during the course of the Services. As such, the Company agrees to maintain the confidentiality of any such information and to use it solely for the purpose of providing the Services.

  1. Intellectual Property

Any materials or documents provided by the Company as part of the Services, including but not limited to reports, presentations, and recommendations, shall remain the property of the Company. The Company grants you a limited, non-exclusive, non-transferable license to use such materials for the sole purpose of implementing the recommendations contained therein.

  1. Limitation of Liability

The Company shall not be liable for any indirect, consequential, or punitive damages arising out of or in connection with the Services or these Terms. The Company’s total liability for any claim arising out of or in connection with the Services or these Terms shall not exceed the amount of fees paid by you for the Services.

  1. Termination

Either party may terminate the Services at any time upon written notice to the other party. Upon termination, you will be responsible for any unpaid fees for the Services provided up to that point.

  1. Governing Law

These Terms and the relationship between you and the Company shall be governed by the laws of the State of Queensland, Australia.

  1. Dispute Resolution

Any disputes arising out of or in connection with the Services or these Terms shall be resolved through mediation in accordance with the Mediation Rules of the Institute of Arbitrators & Mediators Australia. If mediation is unsuccessful, the parties agree to submit the dispute to arbitration in accordance with the Rules of the Institute of Arbitrators & Mediators Australia.
